The agreement between Bright Home Retreat and our clients. Please read carefully before engaging our services.
Last updated: January 15, 2024 · Effective since: January 1, 2022
By accessing the Bright Home Retreat website, requesting a consultation, or signing a project contract, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any provision of these Terms, you must not use our website or engage our services. These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and Bright Home Retreat ("Company," "we," "us," or "our").
Specific project engagements are governed by separate written contracts that incorporate these Terms by reference. In the event of a conflict between these Terms and a specific project contract, the project contract controls for that engagement.
Bright Home Retreat provides premium home renovation services to residential property owners across the United States, including but not limited to:
We reserve the right to modify, suspend, or discontinue any service at any time. We will provide reasonable notice to active clients of any material change to a service in progress.
Each renovation project is governed by a written contract that specifies:
No work begins until both parties have signed the project contract and the client has provided the initial deposit. Verbal agreements or email exchanges do not constitute binding project contracts.
All project pricing is quoted as fixed-price contracts unless explicitly designated as time-and-materials or cost-plus in the project contract. Prices are valid for 30 days from the proposal date. Prices do not include applicable state and local sales taxes, permit fees, or utility connection fees unless explicitly stated.
Standard payment schedules for fixed-price projects:
Payments not received within 7 days of the due date accrue interest at 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less. We may suspend work on any project with past-due balances without penalty.
Where financing is arranged through our lending partners, the financing agreement is a separate contract between you and the lender. Bright Home Retreat is not a party to financing agreements and bears no responsibility for financing decisions, interest rates, or loan terms.
Any modification to the approved project scope must be documented in a written change order signed by both parties before the modified work begins. Change orders specify:
Verbal change orders are not valid. Work performed without a signed change order is performed at our risk, not yours. Change orders caused by hidden conditions (rot, mold, code violations discovered during demolition) are documented with photographic evidence and priced transparently.
Project schedules are estimates based on conditions known at contract signing. We commit to the contracted completion date, subject to:
If we cause a delay beyond the contracted completion date without justification, we will pay liquidated damages as specified in the project contract, typically $100–$500 per day, capped at 10% of contract value.
We provide a five-year workmanship warranty on all renovation projects, effective from the project substantial completion date. This warranty covers defects in installation workmanship, including:
This warranty does not cover:
To file a warranty claim, contact us at info@brighthomeretreat.com with your project number and a description of the issue. We will respond within 5 business days to schedule an inspection. Approved warranty repairs are performed at no cost to you, including labor and materials.
Manufacturer warranties on roofing, solar panels, windows, and HVAC systems pass through to you directly. We facilitate warranty registration on your behalf but are not the warranty provider for these items. Extended workmanship warranties up to 7 years are available on Estate-tier packages.
To enable successful project completion, clients agree to:
Clients may cancel a project contract within 3 business days of signing for a full refund of the deposit, as required by federal and state consumer protection laws. After 3 business days, the deposit is non-refundable to cover committed material orders and schedule reservation costs.
Either party may terminate a project contract for cause if the other party materially breaches the contract and fails to cure the breach within 15 days of written notice. The client pays for all work completed and materials purchased up to the termination date, plus a reasonable termination fee of 10% of the unpaid contract balance.
Clients may terminate for convenience (no breach by us) with 7 days' written notice. The client pays for all work completed, materials purchased (including custom, non-returnable items), de-mobilization costs, and a 20% termination fee on the unpaid contract balance.
To the maximum extent permitted by law, Bright Home Retreat's total liability arising from or related to a project contract is limited to the contract price for that specific project. We are not liable for:
We maintain general liability insurance of at least $2,000,000 per occurrence and workers' compensation insurance as required by law. Certificates of insurance are available on request.
All design documents, renderings, plans, and specifications created by Bright Home Retreat remain our intellectual property until full payment is received. Upon full payment, the client receives a non-exclusive license to use the design documents for the specific project property.
We may photograph and document completed projects for marketing purposes, including before-and-after images, case studies, and social media. We will not display the client's name, address, or identifying details without explicit written consent. Clients may opt out of marketing use at any time.
You may use our website for lawful purposes only. You agree not to:
All website content, including text, images, graphics, logos, and design elements, is the property of Bright Home Retreat or its licensors and is protected by U.S. copyright and trademark laws.
We are committed to resolving disputes fairly and efficiently. The following process applies to any dispute arising from these Terms or a project contract:
Both parties agree to first attempt to resolve any dispute through good-faith direct negotiation. The complaining party must send a written notice describing the dispute; the parties have 30 days to reach resolution.
If direct negotiation fails, both parties agree to attempt mediation with a neutral mediator mutually agreed upon, with costs split equally. Mediation must occur within 60 days of failed negotiation.
If mediation fails, the dispute will be resolved through binding arbitration administered by the American Arbitration Association under its Construction Industry Arbitration Rules. Arbitration will occur in Henrico County, Virginia. The arbitrator's award is final and binding, with judgment enforceable in any court of competent jurisdiction.
All disputes will be resolved on an individual basis; class actions and class arbitrations are not permitted.
These Terms and any dispute arising from them are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. For projects performed in other states, local contractor licensing laws and lien laws of that state apply to the extent they impose greater protections on the client.
We may modify these Terms at any time by posting the updated version on this page with a revised "Last updated" date. Material changes will be communicated to active clients by email. Your continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
These Terms were last comprehensively reviewed by our legal counsel in January 2024.
